ZONINGS AND REZONINGS
Zoning schemes stipulate what type of buildings and what type of activities can occour in a particular area. In technical terms, a zoning scheme is a legal document that records all land use rights on properties in its area of jurisdiction. It also includes regulations pertaining to restrictions on such rights and how they can be exercised. Within a zoning scheme there are certain things that can be done as a right and certain things that require are permitted with the local authorities consent (know as a consent use). For minor deviations from the zoning scheme, one can get a departure. For major deviations, change in usage and change in type of building, one requires a Rezoning.
Zoning schemes differ from one local authority to the next. Currently there are over 20 different zoning schemes operating within the City of Cape Town, originating from all the smaller local authorities which were amalgamated to form the City of Cape Town. The city is currently working on an Integrated Zoning Scheme (IZS) in order to standardize zoning arrangements and achieve consistency and efficiency throughout the City. It is consolidating and rationalizing the zoning schemes into a single standard Integrated Zoning Scheme (IZS) for the entire city. However, until the new scheme is promulgated, the existing ones remain in force.
